General Terms and Conditions (GTC) – Plain Language
Note:
These General Terms and Conditions (GTC) are written in plain language to make them easier to understand. Only the complete original text of the GTC is legally binding.
§ 1 Who do these rules apply to?
These rules apply to all purchases you make in the online shop www.bklynsoap.com. When you place an order, these rules automatically apply. Other rules only apply if we have explicitly accepted them beforehand.
§ 2 When does a contract come into effect?
When you see something in the shop, it is not yet a binding offer. Only when you submit your order do you make an offer. We accept your offer when we send you a confirmation by email within 2 days.
§ 3 How can you pay?
The prices in the shop include VAT, and shipping costs are added. You can pay by instant transfer, invoice, prepayment, credit card, or PayPal. If you pay with PayPal, their rules apply. If you pay late, we may charge interest. For purchases on account via Klarna, you first receive the goods and have 14 days to pay.
§ 4 Who owns the goods?
The goods belong to us until you have paid for them in full.
§ 5 When will you receive your order?
We will deliver your order within 5 working days. If you pay by bank transfer, the period begins after receipt of payment. If a product is not available, we will inform you and you will receive your money back. If you are a business, you bear the risk from the moment of handover to the transport service provider.
§ 6 What happens if you do not accept the goods?
If you do not accept the goods or provide us with incorrect information, we may claim damages. You will also have to pay interest. If you can prove that no damage or only minor damage occurred, you will have to pay less.
§ 7 What if the goods are damaged?
If there is something wrong with the goods, you can choose: new goods or repair. We may refuse the chosen option if it is too expensive. Then you will receive the other option.
§ 8 When are we liable?
We are always liable if we act intentionally or with gross negligence, or if someone is injured. For minor errors, we are only liable if an important duty has been violated. In other cases, we are not liable. This also applies to our employees.
§ 9 How do we handle your data?
We treat your data confidentially and comply with the laws. We only pass it on if it is necessary for the order. You can find more information in our privacy policy, which we also provide in plain language.
The privacy policy in plain language can be found at the bottom of this page.
§ 10 Which law applies and which court has jurisdiction?
All contracts are governed by German law. This means that the laws of Germany apply. If you come from another country, you may not be put in a worse position than your country prescribes.
If a dispute arises and you are a business, the court in Hamburg is responsible. This also applies if you do not have a residence in the EU.
§ 11 What happens if a rule is invalid?
If a rule in these GTC is invalid or cannot be applied, all other rules remain valid.
